The registered proprietor also has the remedy to take infringement action<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e7f19d2 elementor-widget elementor-widget-heading\" data-id=\"e7f19d2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Before Courts- Criminal Remedy<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3d352b4 elementor-widget elementor-widget-text-editor\" data-id=\"3d352b4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Besides Civil remedies, the proprietor of the trademark as well as licensed users also has the option to initiate criminal prosecution against the infringers etc. Following acts have been recognised as offences, against which a criminal complaint can be registered<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-83b6689 elementor-widget elementor-widget-heading\" data-id=\"83b6689\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Confiscation of imported goods bearing counterfeit marks<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7985e96 elementor-widget elementor-widget-text-editor\" data-id=\"7985e96\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p align=\"justify\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 Indian Customs Act, 1962 provides for confiscation of imported goods bearing counterfeit marks if upon a representation made to Chief Customs Officer, he has reasons to believe that the alleged goods bear a false\/ counterfeit Trade Mark. The Chief Customs Officer may require the importer of the goods or his agent to produce any documents in their possession relating to said goods along with information as to the name and address of Consignor as well as importer of said goods and may initiate proper action for non compliance or offence.<span class=\"style65\">Trans-border Reputation <\/span>Trans-border reputation of trademarks is well recognised and accepted in India even if said mark is not registered in India<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6bdabb0 elementor-widget elementor-widget-heading\" data-id=\"6bdabb0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Limited Liability Partnership<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8a842b1 elementor-widget elementor-widget-text-editor\" data-id=\"8a842b1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>LLP is a separate legal entity having limited liability aspect of a Company. It is a distinct legal entity from its partners, can own assets in its name, sue and be sued. Unlike corporate shareholders, the partners have the right to manage the business directly. It has minimum of 2 partners and there is no limit as to maximum number of partners. It is governed in India by Limited Liability Partnership Act 2008 notified on 31.03.2009. The rights and duties of partners in LLP, will be governed by the agreement between partners and the partners have the flexibility to devise the agreement as per their choice. The duties and obligations of Designated Partners shall be as provided in the law<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7131973 elementor-widget elementor-widget-heading\" data-id=\"7131973\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Enforcement of Patent Rights\/ Patent Infringement<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-03fc7bc elementor-widget elementor-widget-text-editor\" data-id=\"03fc7bc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p align=\"justify\">Patent infringement proceedings can only be initiated after Grant of patent in India but it may include claim retrospectively from the date of publication of Patent in Indian Patent Journal subject to law of limitation. Offering anyone of the above<br \/>Burden of proof<br \/>The onus of establishing the infringement is on the plaintiff. However, in case of patent involving a process for obtaining a product where the plaintiff first establishes that the products obtained are identical, the court may shift onus on the defendant Interim Injunction The Court may also allow interim injunction against the infringer<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2e045ea elementor-widget elementor-widget-heading\" data-id=\"2e045ea\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Defences to Infringement of Patent in India<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-589e796 elementor-widget elementor-widget-text-editor\" data-id=\"589e796\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The following defences are available in India as a defence in Patent Infringement: 1. Any of the grounds under which Patent can be revoked<br \/>2. By govt of India or for Govt. of India for its own use<br \/>3. Experiment or research<br \/>4. Imparting instructions to pupils<br \/>5. For Patent in respect of Medicine or drug, for its own use of Govt. of India, for distribution in Govt. Dispensary and hospitals or by gazette notifications to other dispensaries, hospitals and medical institutions<br \/>6. Enforcement of Copyright India is a member of the Berne Convention and TRIPS, therefore owner of copyright from another member country will get same copyright protection in India. However, the duration of copyright shall not exceed the original duration in the member country<br \/>7. Infringement of copyright Copyright in a work is deemed to be infringed when any person, without a license granted by the owner of the copyright does anything, the exclusive right to do which is by the Act conferred upon the owner of the copyright.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-73ddf1d elementor-widget elementor-widget-heading\" data-id=\"73ddf1d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Acts Constituting Infringement of copyright<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b9d80a8 elementor-widget elementor-widget-text-editor\" data-id=\"b9d80a8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The following acts if done or authorised to be done by someone else, without consent or permission of the copyright owner, are considered as infringement of copyright:<br \/>1. Reproducing the work in any material form<br \/>2. Issuing copies of the work to the public not being copies already in circulation<br \/>3. Including the work in any cinematographic film<br \/>4. Making an adaptation of the work<br \/>5. Doing any of the acts specified at (i) to (iii) above in relation to adaptation of work<br \/>6. Communicating the work to the public, if aware that such act shall amount to infringement of copyright<br \/>7. Making, selling, letting on hire, distributing, importing or holding trade exhibits in public of infringed work<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d12c64f elementor-widget elementor-widget-heading\" data-id=\"d12c64f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Appropriate forum for Design Violation<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1adab53 elementor-widget elementor-widget-text-editor\" data-id=\"1adab53\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>A suit for piracy of design has to be filed in a District court within whose territorial jurisdiction the cause of action has arisen. However, as soon as any ground as to cancellation of design is taken in said suit or any other proceedings, only high court has the jurisdiction of entertain the matter and the matter has to be transferred to High Court for decision.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ceaea1d elementor-widget elementor-widget-heading\" data-id=\"ceaea1d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Test to determine Copyright Violation\/ infringement<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-19daf2a elementor-widget elementor-widget-text-editor\" data-id=\"19daf2a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>One of the surest test to determine whether or not there has been a violation of copyright is to see if the trader, spectator, or the viewer after having read or seen both the works would be clearly of the opinion and get an unmistakable impression that the subsequent work appears to be a copy of the first.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3947045 elementor-widget elementor-widget-heading\" data-id=\"3947045\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Before Copyright Registry- Administrative Remedy<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-15bfaf1 elementor-widget elementor-widget-text-editor\" data-id=\"15bfaf1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Registrar of Copyright has the power to ban import of infringing copies into India and delivery of infringing copies of copyright work confiscated earlier from infringer to the owner of the copyright on an application made by the owner of copyright or his duly authorized agent.<br \/>Before Courts- Civil Remedy<br \/>The owner of the copyright has the following remedies against infringement.<br \/>1. Injunction- Ex parte\/ permanent<br \/>2. Damages<br \/>3. Anton Pillar Order<br \/>4. Seizure of goods<br \/>5. Rendition of accounts<br \/>Before Courts- Criminal Remedy<br \/>Copyright Infringement is a cognizable offence (non-boilable offence) the offence of infringement of copyright is punishable with imprisonment, which may extend from a minimum punishment of 6 months to maximum of 3 years and with a fine not less than fifty thousand rupees and extending up to two lakh rupees. For the second and subsequent conviction the minimum term of imprisonment is increased to minimum one year and minimum fine is one lakh rupees.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cb1b4dd elementor-widget elementor-widget-heading\" data-id=\"cb1b4dd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Enforcement of Copyright<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-393ed30 elementor-widget elementor-widget-text-editor\" data-id=\"393ed30\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>India is a member of the Berne Convention and TRIPS, therefore owner of copyright from another member country will get same copyright protection in India. However, the duration of copyright shall not exceed the original duration in the member country.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6930645 elementor-widget elementor-widget-heading\" data-id=\"6930645\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Piracy of Design<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a37cadb elementor-widget elementor-widget-text-editor\" data-id=\"a37cadb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Following acts without consent or license from the registered proprietor amount to piracy of registered design: 1. Apply or cause of apply to any article in any class in which design is registered, the design or fraudulent or obvious intimation thereof for sale<br \/>2. Import any article in any class in which design is registered, the design or fraudulent or obvious intimation thereof<br \/>3. Knowingly publish or expose or cause of publish or expose for sale an article in any class in which design is registered where design or fraudulent or obvious intimation thereof has been applied.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-91359a8 elementor-widget elementor-widget-heading\" data-id=\"91359a8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">- Damages towards piracy of design<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b28cbfb elementor-widget elementor-widget-text-editor\" data-id=\"b28cbfb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>For any piracy of registered design the defendant has to pay sum up to Rs. 25,000 towards the contravention.
